I have to be out of the country for almost a year, beginning August and until 15th of July.
To prepare for this I applied for my AP in June, thinking that it will take about 30-45 days to be approved. As Luck would have it, my AP was accepted in a week and now I have an expiry on it for the 1st week of June.
Here are my questions:
I still have 2 weeks before I leave for my trip, now is it advisable to apply for another AP this week and wait for it to come?
Will that application make my current AP invalid?
From what I understand, you need to be here in the US while you apply for your AP, but can travel on your older AP while this one is still in process. Is this correct?
Is there a chance for AP denial, and how does that affect the chance of an AP extension in Future?

I got my approval today after the CP appointment. I am still waiting for my passports though. I will update you guys with details once I receive my passports.

A few website people are posting links on such threads soliciting business and traffic. We are deleting such posts. Despite requests a few such sites have refused to put IV banners on their sites, deleted our posts or asked for money for any kind of publicity on their sites. But if we do a E-File and if we select where was your 485 filed and pending as nebraska then it generates a LIN recipient notice number which is nebraska. (even if you live in a state for Texas)
This is why it caused confusion for me. (even after reading 485 instructions)
Also i read IV forums and saw attorneys recommend filing to the 485 pending center.
So that is why i posted this question to the attorneys.

I currently hold H1b visa (cap quota), i have an offer from a non profit organization and they are willing to sponsor for my H1b (non cap as this is from a non profit org). I'd like to know will there be any problem if in future i plan to move to a company that will sponsor h1b (cap). How difficult is to transfer from non cap h1 to cap h1?
I read online that if i plan to move from a non-cap h1 to cap h1 in future i have to apply in April under the general quota and wait until Oct to start work again. though i can work until the petition is pending.
I'd really appreciate any advise...

I hate the fact, we let ourselves be discussed amongst the ILLEGAL immigration pool. We are not here illegally, there is no reason we should call this "GC for sale". We are helping the govt. by not just words but with our $$$.
We are here legally , paying taxes, paying rents etc. This fee is meant to speed up processing. No other terminology should be used at IV. Let anti-immigrants talk what they want.
Please remember, at any point there are always opposing forces at work. For those anti-immigrants I have no time or energy to ponder on there xenophobic reservations.
Lets not forget, America was and continues to prosper because of hardworking and honest immigrants..

I had the same problem last year.
1. Attorney Aron Finkelstein in Sheila murthy office helped me out.
This is what we did, We filed an MTR to consider my case in Eb3, with it we also attached a new application for Eb3 and specified in Mtr, to consider our new application if they fail to accept my MTR. My new application for Eb3 was approved.
I cant help you on your EAd and stuff ,as I know your EAD becomes invalid immediately once your 485 is denied, which will be denied if your underlying 140 application is denied.
I would suggest, you contact a attorney soon.
My suggestions are my experience and stuff, I am not an attorney to give you legal advise.

I am one of the July 2 filers. I need to go to India on 1st November. I was hoping that AP will come by that time. But there has been no progress on that. Just spoke to my Attorney. She said that USCIS does not have any facility to issue AP for an emergency.
Then I called USCIS. I was told the same thing. The Customer Service representative said - I should go wherever I need to go. On arrival contact the local US Embassy and tell them that you need AP to travel back. They will "guide you".
On this forum I have read about INFOPASS many times. I was hoping to use that facility if I did not get AP in time. I am trying to find out if anybody actually used INFOPASS to meet a local Immigration Officer and got AP on an emergency basis.
No theoretical guesses please.

How many of you support this idea ?
Rally in DC in the morning and Fasting till 5PM in front of the capitol.
I will certainly support if I know the cause for this fasting & if I know more details on this rally?
btw: I can also support by dancing and singing all night long (of course it comes out naturally after I have 5-6 drinks....:D) just kidding..
when you get a chance give more details on the cause for this rally, date etc., and see how I can support.

My Employer is paying for my Family GC Expenses (Myself, Wife, and Daughter). I have been working for him for the last 3 years. At the time of Filing my Labor, I have signed a letter (Just a letter on Company Letter Head) and faxed him the copy and the Original is with me. The letter says I have to pay back all the expenses for my GC if I leave the Employer before my GC approval time + 6 months.
My priority date is July 2006 in EB3 and 485 was filed on July 3rd. Based on the current trend it might take another 4 to 5 years to get my GC. My employer pays me very less and is not willing to give any hike in near future.
After 180 days (AC21), I want to change my employer. In the above scenario, can my present Employer sue me if I leave him? Please suggest�

Yes I have done recently ( Last week)
I went to France consulate and all they wanted to see was my EAD so if you have Valid EAD u should be fine
